Terms and Conditions

Last updated: 5 November 2026

§ 1 Scope

(1) These terms and conditions apply to all orders placed by consumers and businesses (hereinafter "customer") via the online shop of iSolarPro GmbH, Bullermannshof 11 / Tor 20, 47441 Moers, Germany (hereinafter "we").

(2) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession (§ 13 BGB). A business is any natural or legal person or partnership with legal capacity acting in the exercise of its trade, business or profession when concluding a legal transaction (§ 14 BGB).

(3) Deviating terms of the customer only apply if we expressly agree to them in writing.

§ 2 Conclusion of the contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

(2) By clicking "Order with obligation to pay", the customer submits a binding offer to purchase the goods in the shopping cart. Before submitting the order, the customer can check and correct their entries at any time.

(3) We confirm receipt of the order by email without delay. This confirmation of receipt does not yet constitute acceptance. The contract is concluded when we accept the order by separate email (order confirmation), dispatch the goods or make them available for pickup, or at the latest when we send the payment request for prepayment.

(4) The contract languages are German and English. We store the contract text and send the customer the order details and these terms in text form.

§ 3 Prices and VAT

(1) The prices shown in the shop at the time of the order apply, plus shipping costs. Depending on the selected display, prices are shown at 0 % VAT or including 19 % VAT; VAT is shown separately in the cart and at checkout.

(2) The 0 % VAT rate pursuant to § 12 (3) of the German VAT Act applies to solar modules, inverters, battery storage and essential components if the customer is the operator of the photovoltaic system and the system is installed on or near private homes, apartments, or public and other buildings used for activities serving the common good. The customer confirms this with a declaration when ordering. If it turns out that the requirements were not met, we are entitled to charge the statutory VAT subsequently.

(3) Non-qualifying goods (e.g. wallboxes, heat pumps, portable power stations, tools) are always charged at the statutory VAT rate.

§ 4 Payment

(1) The payment methods displayed during the ordering process are available.

(2) For prepayment, we grant a 2 % discount on the value of the goods. The invoice amount must be transferred to our account within 7 days of receipt of the order confirmation. If payment is not received on time, we may withdraw from the contract after an unsuccessful reminder.

(3) Purchase on invoice is reserved for registered business customers after approval. Invoices are payable within 14 days of the invoice date without deduction unless otherwise agreed.

§ 5 Delivery and pickup

(1) We deliver within Germany and to the countries listed in the shop. The delivery time is stated for each product (usually 5–12 working days) and begins, for prepayment, on the day after receipt of payment, otherwise on the day after conclusion of the contract.

(2) Freight goods (e.g. pallets of solar modules or heavy batteries) are delivered to the kerbside or at ground level at the delivery address, provided it is accessible by truck. Unloading may require assistance; the forwarder will contact the customer in advance to arrange an appointment.

(3) If pickup is selected, the goods can be collected during opening hours at the chosen warehouse after our "ready for pickup" notification. If the goods are not collected within 14 days, we will set a reasonable grace period.

(4) If the ordered goods are not available because we are not supplied by our supplier through no fault of our own, we will inform the customer without delay and refund any payments already made.

§ 6 Retention of title

The goods remain our property until paid in full. With respect to businesses, we retain title until all claims arising from the ongoing business relationship have been settled.

§ 7 Transport damage

If goods are delivered with obvious transport damage, we ask the customer to complain to the carrier immediately, note the damage on the delivery note and inform us as soon as possible. For consumers, failure to do so has no effect on their statutory rights; however, it helps us to assert our claims against the transport company.

§ 8 Liability for defects and guarantees

(1) The statutory rights for defects apply.

(2) With respect to businesses, the limitation period for claims for defects in new goods is one year from delivery; the duty to inspect and give notice of defects pursuant to § 377 HGB remains unaffected. This does not apply to claims for damages or in the case of fraudulent intent.

(3) Manufacturer guarantees (e.g. product and performance guarantees for solar modules) exist in accordance with the respective manufacturer's guarantee terms in addition to the statutory rights and do not restrict them.

§ 9 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the Product Liability Act. In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

§ 10 Right of withdrawal

Consumers have a right of withdrawal in accordance with our withdrawal policy. Businesses have no statutory right of withdrawal.

§ 11 Final provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law only applies insofar as it does not deprive them of the protection granted by mandatory provisions of the law of the state in which they have their habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction for all disputes is our registered office.

(3) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
